In one of the many litigations relating to the Rajiv convicts, the Centre had told the Madras High Court (August 2020) that these seven lifers were "only arrows" to carry out the task, and the MDMA would uncover the "bows" from which the arrows were released. As it turned out, Arivu's averment of innocence turned out to be true as the IPS officer V Thiagarajan, who was the SP drafted from the Kerala cadre to the SIT and given the task of recording the statements of all the accused, finally yielded to the feeling of guilt that weighed down his conscience and filed an affidavit in November 2017 — some 26 years later - admitting that he 'omitted certain crucial fact' while recording Perarivalan's statement, including his insistence that he did not know why he was asked to get the batteries. But of course, SIT boss D R Karthikeyan continues to insist he did a great job sewing up the near-impossible case and bringing the culprits to book. The judge did 'carpet-bombing' sentencing all the 26 accused to death on January 28, 1998; obviously choosing to play safe in such a highly sensational case that he knew would drag on through appeals and more appeals up to the Supreme Court. Only four of those 26 were 'condemned' to death row by the apex court, while three were sentenced to life and the rest acquitted. The charge against Arivu was that he was party to the brutal assassination by a woman LTTE suicide bomber Thanu, as he procured the two nine-volt batteries to be fitted to her belt bomb. "Arivu, here, take this," someone handed over a parai (an ancient drum instrument of the Tamil people used usually to convey messages to the public, such as the dynastic rulers' orders) to egg him on to join a young woman gustily playing on her parai to announce the good news.

In a 2017 interview with The Indian Express, Justice K T Thomas, who headed the SC Bench that awarded the final order in the Rajiv Gandhi assassination case, said Perarivalan’s case had brought to the fore another aspect that generated intense debate — using the confession of one accused against another. He was in constant touch with Perarivalan until his death. The sentence was commuted to life imprisonment by the Supreme Court on February 18, 2014, along with the death sentences awarded to other convicts in the case, Murugan and Santhan. Four witnesses were examined by the TADA court regarding the battery to corroborate Perarivalan’s confession. Thiagarajan revealed that Perarivalan had admitted to having purchased the batteries, but he did not know the purpose for which they would be used. But the two other judges on my Bench did not agree, they insisted that we should use it as substantive evidence. His parole was subsequently extended on “health grounds”. The Supreme Court granted him bail on March 9, 2022. The Governor sat on the recommendation for two-and-a-half years before forwarding it to President Ram Nath Kovind in February 2021, and the delay continued. But the matter continued to lie with Rashtrapati Bhavan. The Governor faced strong remarks from the Madras High Court in July 2020. On May 11, the SC completed the hearing and reserved its orders. A G Perarivalan alias Arivu, 50, was only 19 when he was arrested on June 11, 1991.

I badly miss him when I recall the gift he gave me when he was released in 1999 — his shoes, a shirt and a pair of trousers — insisting that I wear them on the day I get released. It was Justice V R Krishna Iyer, who stood like a pillar of support in my fight. She died of cancer later, I never got a chance to meet her. My friend and brother, Sekar, an accused who was released in the case, is abroad now. There were days when I was desperate to see a baby in prison. I told someone earlier how I used to obsessively count the bricks on the wall, take measures of the door and bolts and imagine the smells I craved. But yes, I have to sit with Amma and talk to her. I miss Selva anna (Selvaraj), who has been abroad for the past few months. I don’t remember if I tried to comfort her.

He was accused of having bought two 9-volt ‘Golden Power’ battery cells for Sivarasan, the LTTE man who masterminded the conspiracy to assassinate Rajiv Gandhi. The batteries were used in the bomb that killed the former Prime Minister on May 21 that year.

Article 142 essentially provides that the country’s apex court can pass such orders or decrees as it deems fit in order to do complete justice in cases before it.
